§1. Definitions
- Provider — Artur Niklewicz, Warsaw (operator of skalujto.ai; contact details in the site footer).
- Site — the website at skalujto.ai and its subdomains.
- Client — individual, legal entity or organisational unit using the Site or ordering services.
- Services — design, development, consulting and training work described on the Pricing page.
- Contract — written or electronic master agreement with a SOW annex defining scope, timeline and price.
§2. Scope of services
We provide web application design and development (Next.js, React), backend systems (FastAPI, Postgres), AI-layer integration (RAG, LLM, agents) and developer team training. The precise scope of each engagement is defined in its SOW. Services are delivered remotely; on-site meetings in Warsaw or at the Client's office are possible on request.
§3. Contract formation
- Initial contact via form or email. We respond within 24 business hours with a call proposal.
- After the call we prepare a fixed-price quote and a draft timeline. The quote is valid for 14 days.
- Contract and SOW are signed electronically (e.g. Autenti, DocuSign) or on paper.
- Kickoff is defined in the SOW — typically 2-4 weeks after signing.
§4. Prices and payments
Baseline prices are published at /pricing. Settlements are in PLN. VAT is not added until the company registers as a VAT taxpayer; after registration the rate is 23%. Standard payment schedule: 40% deposit at kickoff, 30% on prototype delivery, 30% on acceptance. Invoice payment term: 14 days. Delay over 30 days entitles us to suspend work.
§5. Liability
- We are liable for performing services to industry standards.
- We are not liable for indirect damages, lost profits or the actions of third parties (cloud providers, external integrations).
- Our total financial liability is limited to the fee for the specific stage in which the damage occurred.
- The above does not apply to damages caused wilfully — here liability follows the Polish Civil Code.
§6. Complaints
Submit complaints to hello@skalujto.ai within 14 days of noticing the defect. Include a description, reproduction steps and expected resolution. We respond within 14 business days. Valid complaints are fixed free of charge. Rejected complaints are justified in writing.
§7. Personal data
We process personal data per the Privacy policy at /privacy. If Client data (e.g. during an implementation) is entrusted to us, we sign a separate Data Processing Agreement (DPA) as an annex to the master contract.
§8. Final provisions
- These terms apply in the version in force at the time of contract signing.
- Changes are published on the site with an effective date. Ongoing contracts keep the version from the signing date, unless the parties agree otherwise.
- Matters not covered here are governed by Polish law: Civil Code, Act on Providing Services by Electronic Means, Copyright Act, GDPR.
- Disputes are settled by the court competent for the Provider's seat. Before litigation the parties will attempt amicable resolution for 30 days.
